Payments and terms of service

Everything you pay for, and everything you agree to, on one page. Read it before you send money. Paying an invoice or a payment link means you accept these terms in full.

Read this first

wpCRISIS expressly requires Cloudflare and strongly recommends Kinsta on every site I work on. This is not a preference. Most of the emergencies I get paid to fix are caused by cheap hosting with no staging, no real backups, and no edge protection in front of the site.

If your site is not behind Cloudflare, I will put it there or I will tell you why the fix will not hold. If your host cannot produce a working restore point on demand, understand that you are paying me to work without a safety net, and the recovery guarantee below does not apply.

Prices are in US dollars and exclude any taxes that may apply. Quoted prices are valid for 72 hours. Two emergency engagements are taken per day, first paid, first served. Work starting after 4:00 PM Central or on a Saturday bills at double.

1. Payment is due before work begins

Diagnosis is $97, paid before I look at anything. Emergency fixes and rescues are paid in full up front through the payment link I send you. Retainers are billed monthly in advance and renew automatically until cancelled. I do not invoice on net terms, and I do not start work on a promise to pay.

2. The diagnosis fee and how the credit works

The $97 diagnosis buys my time and my judgment, not a sales call. You get the actual cause, in writing, plus a flat quote to fix it. Accept the quote and the full $97 is credited against the fix. Decline it and the diagnosis is yours to keep, take to anyone you like, and the fee is non-refundable because the work was already done. One site, one reported problem, per diagnosis.

3. What a flat price covers

A flat price covers the one issue named in the quote. It does not cover unrelated problems discovered along the way, feature requests, redesigns, content work, or repairs to damage caused by other parties after I hand the site back. Those are quoted separately before I touch them.

4. The 24 hour guarantee, and its limits

If I take a paid emergency fix and cannot return the site to a clean and stable state within 24 hours of receiving working access, you get a full refund of that fee. The guarantee does not apply when:

  • Access, credentials, or host permissions are not provided, are wrong, or arrive late.
  • The failure is at the host, registrar, DNS, CDN, or a third party service and outside my control.
  • No usable backup or restore point exists and the site data is already lost.
  • Another person or process changes the site while I am working on it.
  • The work requested is not a repair, such as a rebuild, migration, or new development.

5. Backups are your responsibility

Before I start, you either supply a current backup or you authorize me to create one where the host allows it. I am not liable for data loss on a site that had no recoverable backup when I received it. Emergency work happens on damaged systems, and some damage predates my involvement and cannot be undone.

6. Access and credentials

You warrant that you own the site or are authorized to grant access to it. You are responsible for rotating every credential you share with me once work is complete. Credentials are used only to perform the work you paid for and are never shared or resold.

7. Malware, reinfection, and hardening

A cleaned site can be reinfected through the same door it was breached through: an outdated plugin, a shared password, a compromised local machine, or a neighbor account on shared hosting. A rescue includes hardening, but no one can guarantee a site will never be compromised again. Reinfection after handoff is new work.

8. Third party services

Hosts, plugins, themes, payment processors, CDNs, and email providers are operated by other companies. I do not control their uptime, pricing, policies, updates, or defects, and I am not responsible for outages, failures, or costs originating with them.

9. No guarantee of business outcomes

Nothing here is a promise of search rankings, traffic, conversions, revenue, or performance scores. I fix and stabilize software. What your site earns afterward is a business result with too many other inputs to guarantee.

10. Retainers

A priority retainer is a flat monthly fee for position and readiness: priority response, preferred scheduling, emergency availability, retained access and environment documentation, and periodic health checks at your tier. It is not prepaid labor. Repairs, rebuilds, and new development are quoted separately at your tier discount.

Retainer fees are non-refundable for the month in progress and renew automatically until cancelled. Cancel any time before the next renewal date and the retainer ends at the close of that period. Response commitments apply during dispatch hours and are best effort, not a contractual service level with penalties.

Retainer clients run the required platform: Cloudflare, Kinsta, and Kadence. Full stop. There are no exceptions and no grandfathered sites. Migration onto that platform is a fixed price project billed separately and is a condition of the retainer, not an upsell attached to it. You may buy the migration without ever taking a retainer. I do not take retainers on WooCommerce stores, headless builds, or sites on hosting that cannot produce a restore point on demand. Multisite and WPMU networks are supported and priced by subsite count: Sentry covers five subsites, Shield covers ten, and each subsite past that is quoted on what it does and what plugin stack it carries.

11. Plugin cap

Retained sites carry a cap of 20 active plugins per site, or 20 distinct plugins across a multisite network. Cloudflare, Kinsta tooling, Kadence, and must-use plugins are excluded from the count. Plugins 21 through 25 bill at $25 each per month, 26 through 30 at $50 each per month, and a site carrying 31 or more is not accepted on retainer until a Plugin Reduction Audit is completed.

Plugin conflicts compound geometrically rather than linearly, and the response commitments in this agreement are only achievable on a stack of known size. Counts are taken at onboarding and reviewed at each health check. Overage bills from the month after a plugin is added and stops the month after it is removed.

12. Refunds and chargebacks

Outside the 24 hour guarantee in section 4, fees for completed work are non-refundable. If you dispute a charge instead of contacting me, access to services is suspended immediately and any retainer is terminated. Contact me first. Real problems get resolved faster than a bank can process a form.

13. Dispatch hours, daily capacity, and double rate

Standard dispatch is 8:00 AM to 4:00 PM Central, Monday through Friday. I take two emergency engagements per day. Slots fill in the order payments clear, and when the day is full the next opening is the following dispatch day.

Work that starts after 4:00 PM Central, or any time on a Saturday, bills at double every price on this page. That is not a penalty and it is not negotiable. Evenings and Saturdays are family time, and the only thing that buys them back is a number that makes the trade worth it to both of us. A $497 fix is $994 after four. A $97 diagnosis is $194 on a Saturday.

Sundays and US federal holidays are closed. No premium reopens them.

The two engagement ceiling is deliberate. One person working a damaged production site at hour fourteen is how sites get broken worse, and I am not willing to hand you that version of me.

14. Response times

Messages inside dispatch hours are typically answered within one hour. Outside those hours I answer when I am back at the desk. Response times are best effort, not a contractual service level. Retainer clients are answered first and get first claim on the day’s slots.

15. Limitation of liability

My total liability for any claim arising out of the work is limited to the amount you paid me for that specific engagement. I am not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost sales, lost data, or business interruption, even where the possibility of those losses was known.

16. Work is provided as is

Services are provided on an as is and as available basis. To the fullest extent permitted by law, I disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement.

17. Indemnification

You agree to indemnify and hold harmless T28X LLC and its owner against claims, damages, and legal costs arising from your site’s content, your use of licensed software, your compliance obligations, or your instructions to me.

18. Work I will not take

I decline work involving illegal content, fraud, spam operations, unauthorized access to systems you do not own, or removal of security controls placed by a host or law enforcement. I may decline any engagement for any lawful reason and refund anything already paid.

19. Confidentiality and portfolio use

Your business information and site data stay confidential. I may describe the nature of the work in general terms, for example the type of failure and the fix, without naming you or your site unless you agree in writing.

20. Independent contractor

I work as an independent contractor. Nothing here creates an employment relationship, partnership, joint venture, or agency between us.

21. Force majeure

Neither party is liable for delays caused by events outside reasonable control, including outages at data centers or upstream providers, network failures, severe weather, or acts of government.

23. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute is brought in the state or federal courts located in Harris County, Texas, and both parties consent to that venue.

24. Changes to these terms

These terms may be updated. The version in force is the one published on this page on the date you paid. The effective date appears at the top.
